Antecedentes
The defendants placed the song 'Rodila nas majka ispod Bilogore' on cassette and CD as a traditional work without naming M.K. and N.M.M. The ordinary courts found the two claimants to be authors and awarded each HRK 20,000 for moral harm plus HRK 222.92 economic loss.
Historia procesal
After ordinary civil judgments, the publisher and related defendants filed a constitutional complaint alleging arbitrary evaluation of evidence and violation of property and fair-trial rights. The Constitutional Court reviewed the record and rejected the complaint.
