Antecedentes
The complainant claimed copyright in a terracotta bas-relief of paired dancers and asserted that she drew and modelled it. Evidence showed a closely corresponding Bayon-temple sculpture and common Thai/Khmer motifs, creating doubt that most or all of her template had been copied from public-domain sources with only minor additions.
Historia procesal
The public prosecutor charged infringement; the alleged owner joined as co-plaintiff. The Central IP and International Trade Court convicted, imposing three months and THB 60,000, imprisonment suspended for one year. The defendant appealed and the Supreme Court reversed and acquitted.
