Marco y alcance

Autonomous authorial layer: arts. 4-5 require a natural-person creator and creative activity. The Agency's 2026 guidance directly states that a result made without human participation is not a protected work. Ownership of the system, payment, prompting, iteration, selection, commissioning, platform terms or possession of the file does not replace creation of the claimed expression. Assisted layer: arts. 5, 10 and 11 leave room for independently human writing, drawing, code, editing, montage, creative selection/arrangement or transformation. Protection is limited to the human expressive features actually identified and proved; it does not extend by association to model-determined content. Prompting threshold: no national case or binding guideline fixes a number of prompts or percentage of human contribution. A claimant must map each claimed final feature to a person's creative act and preserve drafts, layers, prompts, parameters, intermediate outputs, discarded alternatives and edit history. Software distinction: art. 6.2 protects a qualifying computer program as code, not every output it produces. The programmer, system owner and user are not automatically authors of autonomous output. Employment and commissioning distinction: art. 13 allocates exploitation rights only after a human-author work exists. A work-for-hire or services contract cannot cure missing authorship, although it can govern ownership of the proven human layer. Narrow neighboring-right exception: because a phonogram includes a fixation of other sounds and the producer can be a natural or legal person, the first fixation of synthetic sound may obtain a producer right under arts. 32 and 34. This is an untested statutory inference protecting the recording, not authorship of the generated composition, lyrics, performance, voice or style. Los derechos de terceros permanecen independientes. A certificate cannot establish human creation if the complete file shows autonomous generation. Grant audit: aggregate totals, registration forms, e-government services, certificate templates, ISBNs, deposits, platform notices and generic AI policy publications were excluded as proof of an individual GenAI grant. No grant or substantive denial was verified. Institutional-weight gate: the Agency's 2026 answer is the strongest AI-specific national statement located, but it is guidance rather than an adjudication. The absence of Supreme or Constitutional Court GenAI authority keeps the human-assisted and phonogram boundaries conditioned. Autonomous-status precision: the authorial result is classified NO, not partial. The separate, inferred phonogram-producer right is placed under related rights and cannot soften the authorial answer. Limitaciones documentadas

No Azerbaijani decision was located applying the phonogram-producer neighboring right to wholly synthetic sounds.
