Resultado
Order of 28 November 2024 set aside; inter partes hearing fixed for 15 October 2025; strike-out-of-affidavit application fell away; costs deferred; defendants to draw/file/serve order.
Resumen
Good reason for absence and likelihood of a different procedural order were established. Exceptional circumstances were not established, but were unnecessary.
Antecedentes
Melt Design alleged that a 4 January 2013 asset agreement transferred Syntax Group copyright in drawings, specifications, images, plans and documents for an Antigua hotel. It alleged defendants completed and marketed the hotel using those works without licence; defendants denied ownership, use and an effective written assignment under s 23.
Historia procesal
After disclosure/witness-statement defaults, the defence stood struck out. Judgment without trial was entered in defendants’ absence on 28 November 2024. Defendants applied on 13 December 2024 to set it aside under CPR 11.21; hearing 21 March 2025; decision 25 August 2025.
Cuestión jurídica
Whether defendants showed good reason for non-attendance and likelihood that another order would have been made, or exceptional circumstances, so the 28 November 2024 order should be set aside.
Criterio
Good reason for absence and likelihood of a different procedural order were established. Exceptional circumstances were not established, but were unnecessary.
Fundamento decisivo
Because a pending relief-from-sanctions application would likely have led the court to adjourn and hear both sides, CPR 11.21(3) was satisfied; copyright ownership and alleged fraud were not determined on this application.
Límites
Not an AI, computer-generated-work, originality, authorship or ownership merits precedent; underlying pleaded facts remain allegations. Later inter partes outcome not located in the cutoff corpus.
