Resultado
The district judgment was affirmed; Rökver was ordered to pay Skýrr ISK 600,000 in Supreme Court costs.
Resumen
The court found an implied transfer/assignment in the circumstances. It described article 42b employer ownership as an exception built on premises different in nature from the author’s personal right over a work the author personally created.
Antecedentes
The programmer created a software prototype before formal employment and later worked through corporate/employment relationships. The dispute concerned who could enforce and exploit the program and whether rights had passed to the enterprise.
Historia procesal
Rökver filed on 21 December 2007. Reykjavík District Court rejected its claims on 17 December 2010. Rökver appealed; the Supreme Court affirmed.
Cuestión jurídica
Whether Rökver retained enforceable rights in the software prototype or the human programmer's conduct and corporate relationships effected a valid implied transfer to EJS and its successor.
Criterio
The court found an implied transfer/assignment in the circumstances. It described article 42b employer ownership as an exception built on premises different in nature from the author’s personal right over a work the author personally created.
Fundamento decisivo
The prototype was personally created by the programmer and initially accrued to the employer under article 42b. Later conduct—new employment, system registration, continued development and no reservation—showed an effective transfer, and the original company was bound by the programmer's apparent authority and years of inaction.
Límites
Ownership and implied-transfer dispute involving human-authored software. It distinguishes creation from ownership and does not confer authorship over software outputs.
