Islandia reconoce el derecho de autor automático y no registrado, pero no contiene una ficción de autoría para obras generadas por computadora. La expresión determinada autónomamente por el modelo queda fuera de la mejor lectura humana vigente; cada aporte humano y cada capa de software, audiovisual, fijación, fotografía o base de datos exige prueba propia.

Marco y alcance

La ley vigente atribuye el derecho a un autor humano y la jurisprudencia nacional exige creación intelectual, originalidad, independencia y rasgos distintivos. Una salida autónoma no satisface esa estructura en la mejor lectura actual; una obra asistida sólo puede proteger la expresión humana original, identificable y reflejada en el resultado. Las reglas de titularidad laboral, contratos, fijación, fotografía y bases de datos no convierten al usuario, empleador o productor en autor de contenido autónomo.

Limitaciones documentadas

No se localizó una sentencia islandesa de fondo sobre autoría o subsistencia de una salida de IA generativa. Ningún holding islandés define si prompts, iteración, semillas, parámetros, selección o curaduría satisfacen el umbral de originalidad. No se localizó una decisión islandesa específica de IA que aplique a material sintético derechos de intérprete, fonograma o videograma, radiodifusión, fotografía no artística o productor de base de datos. Los filtros oficiales exactos devolvieron cero expedientes relevantes de IA generativa y derecho de autor, pero el negativo está limitado por indexación pública, migración, OCR, vocabulario y fecha de corte; no es una certificación universal.
